§ 50-36. Board determination.

  • (a)

    Within 30 days of determining that an initial Application is complete or that a renewal Application requires a public hearing pursuant to Section 50-38(b) herein, the DOH-Sarasota shall schedule a public hearing before the Board for consideration of the Application.

    (b)

    In its legislative capacity, the Board shall determine if there is sufficient need in the County for an additional EMTS provider. In reaching its determination, the Board shall consider:

    (1)

    The financial ability of the Applicant to provide the proposed services based on, at a minimum, the following criteria:

    a.

    Financial statements prepared by a CPA or federal tax returns or, for newly formed entities, personal audited financial statements from the principal(s), all in a form in accordance with generally accepted accounting principles;

    b.

    Pro forma statements, all in a form in accordance with generally accepted accounting principles;

    c.

    Credit and bank references, and a current official credit report;

    d.

    Disclosure of any and all pending liabilities; and

    (2)

    The adequacy of the Applicant's operational management plan;

    (3)

    Any recommendations received from municipalities and hospitals within the Sarasota County service area;

    (4)

    The Response Time reports of the current Certificate Holders on file with the County;

    (5)

    The number of complaints on file with the County with respect to the Response Times of current Certificate Holders;

    (6)

    The frequency with which First Responders have been called upon to respond to non-emergency calls because of unavailability of current Certificate Holders; and

    (7)

    Such other information as may be relevant to its determination.

    (c)

    Certificates shall be issued for a term of four years.

    (d)

    Issuance of Certificates shall be conditioned upon Applicant providing proof of insurance as required in Section 50-40 herein within 30 days of issuance. If proof of insurance is not provided within 30 days, the Certificate shall be revoked.
