§ 22-37. Violations, penalties, and enforcement.

  • (a)

    Any person, firm, corporation or agent who shall fail to comply with any provision of this article, or who shall erect, construct, alter, repair, move, or demolish any building, structure, or electrical, gas, mechanical or plumbing system in violation of the plans and specifications submitted and permitted hereunder, or cause same to be done, shall be guilty of a violation of this article. The provisions of this article shall be enforced in the same manner as misdemeanors are prosecuted in accordance with F.S. § 125.69, or by proceedings before the Code Enforcement Special Master, pursuant to F.S. ch. 162, and Ordinance 93-006, as amended.

    (b)

    Each and every day or portion thereof during which any violation of any of the provisions of this article is committed or continued shall be deemed to be a separate offense punishable as provided by this article.

    (c)

    The Board of County Commissioners shall have the authority to enforce the provisions of this article by injunction or other appropriate judicial writ or proceeding notwithstanding the fact that a violation of any of the provisions herein is subject to the penalties provided in section 22-37(a), above. In addition to seeking any penalty authorized by this article, the County is authorized to file an appropriate civil suit in any court of competent jurisdiction for the purpose of removing unsafe buildings, and may also obtain a judgment for the reasonable cost of demolition, said cost to be determined by public bidding. Any judgment for the cost of demolition shall be recorded as a lien against the property on which said unsafe building was located and shall be enforced according to law.

    (d)

    Whoever opposes, obstructs or resists any enforcement officer or any person authorized by the enforcement officer in the discharge of his duties as provided by this article shall be subject to the penalties provided herein.
