§ 38-327. Eligible Participants.

In order to be an Eligible Participant, a property owner (or property) must meet the criteria listed below. The PACE Local Government is responsible for verifying that the following conditions are met:

(a)

Property owner must be the legal owner of the Property and provide proof of ownership in the application for the PACE Program;

(b)

Property must be within the PACE Program boundaries, as defined in Section 38-324;

(c)

Property owner must be in compliance with Section 163.08(8) and (9);

(d)

Property owner cannot be in bankruptcy nor can the Property be an asset in any bankruptcy proceeding; and

(e)

Property cannot be-encumbered by any federal income-tax lien judgment lien or similar lien in excess of $1,000.00;
