§ 2-344. Definitions.

  • For this article, the following terms shall have the meanings set forth in this section unless the context clearly indicates otherwise.

    Board means the Board of County Commissioners of Sarasota County, Florida.

    Clerk means the Clerk to the Board of County Commissioners or such other agency as the Board of County Commissioners may designate, which shall be responsible for the records of code enforcement proceedings and such other matters as provided for herein.

    Code Enforcement Officer means any designated employee or agent of Sarasota County whose duty it is to enforce codes and ordinances enacted by Sarasota County. Employees or agents who may be designated by the County Administrator as Code Enforcement Officers for purposes of this article may include, but are not limited to, code inspectors, law enforcement officers, animal control officers, or fire safety inspectors.

    Code or Codes or Sarasota County Code means any ordinance or ordinances of Sarasota County, Florida, as the same exist, and as they may have been amended and codified as detailed in Section I-1 of the Sarasota County Code, on the effective date of this article, and as the same may be amended from time to time.

    Person means an individual, association, firm, partnership, corporation, trust, or other legal entity.

    Prosecutor means the Assistant County Attorney representing Sarasota County in Code Enforcement proceedings before the Special Magistrates.

    Repeat Violation means a violation of a provision of the Sarasota County Code by a person who has previously been found, by the Special Magistrate or previously existing Sarasota County Code Enforcement Board, or any other quasi-judicial process, or any judicial process, to have violated the same provision within five years prior to the subject violation, whether or not such violations occur at the same locations.

    Special Magistrate means a person appointed pursuant to this article to hold hearings, assess fines, and order mitigation for violations of the Sarasota County Code.

    Violator means the persons or entities owning, occupying, or controlling the property on which a code violation has occurred or remains uncorrected, as well as the persons or entities whose acts or omissions caused the violation.
