§ 22-65. Additional provisions adopted as part of the [Standard] Swimming Pool Code.

  • The following text is added to this code:

    (1)

    Section 105.3.7, Revocation or Suspension of Permits. The Building Official may revoke or suspend the permit or approval issued under the provisions of this code where the application or plans on which the permit or approval was based contained any false statement or misrepresentation as to any material fact.

    (2)

    Section 202, Definitions. BUILDING OFFICIAL—shall be the Director of the Construction and Property Standards Department of Sarasota County or his authorized representative.

    (3)

    Section 105.7, Posting of Inspection Card. Work requiring a permit shall not commence until the permit holder or his agent posts the inspection card issued by the Administrative Authority in a conspicuous place at the construction site. The inspection card shall be protected from the weather and located in such position as to permit the Building Official or other representative of the Administrative Authority to conveniently make the required entries thereon.

    (4)

    Section 107.1, Enforcement. Any person, firm, corporation or agent who violates the provisions of this code or any amendment hereto shall be punished as set forth herein. The erection, construction, alteration, demolition, commencement or performance of any swimming pool work that is inconsistent with the plans or specifications approved under this code by the Administrative Authority shall constitute a violation of this code. The provisions of this code may be enforced in the same manner as misdemeanors in accordance with F.S. § 125.69, by proceedings before the Code Enforcement Special Master, pursuant to F.S. ch. 162 and Ordinance No. 93-006, as amended, or through civil injunctive relief.

    (5)

    Section 107.2. In addition to seeking any penalty authorized by this code, the County is authorized to file an appropriate civil suit in any court of competent jurisdiction for the purpose of removing any unsafe equipment or condition(s) in and around any private swimming pool which is unsanitary, unsafe, unlawful, or where such equipment or condition(s) is in disrepair or lacks maintenance and is a hazard to life, health, property or safety of the public or occupants of the premises and may also obtain a judgment for the reasonable cost of demolition and/or removal of any real or personal property. Any judgment for the cost of demolition or removal of any real or personal property shall be recorded as a lien against the property on which said unsafe real property or abandoned personal property was located and shall be enforced according to law.

    (6)

    Section 107.3. Whoever opposes, obstructs or resists any inspector or Code Enforcement Officer or any person authorized by the inspector or Code Enforcement Officer in the discharge of his duties as provided by this code shall be subject to the penalties provided in Section 107.1.

    (7)

    Section 107.4. Each and every day or portion thereof during which any violation of any of the provisions of this code is committed or continued shall be deemed to be a separate offense punishable as provided by this code.

    (8)

    Section 109, Building Code Board of Adjustments and Appeals. The Building Code Board of Adjustments and Appeals shall have the authority to hear appeals of decisions of and interpretations by the Building Official and consider variances and modifications of this code. The Board of Adjustments and Appeals shall be composed of membership and function as defined in Sarasota County Ordinance No. 83-63, as amended (hereinafter "the building code of Sarasota County"). Upon receipt of an appeal or petition for variance, the Board of Adjustments and Appeals shall hold a public hearing following the same procedures, including standards for granting variances, as provided for under the building code of Sarasota County.
