§ 22-63. Modifications to certain sections of the Standard Swimming Pool Code, 1994 Edition.

  • The following sections are hereby deleted in their entirety and replaced with the following language:

    (1)

    Section 102.1, Administrative Authority. The term "Administrative Authority" as used in this code shall mean the Sarasota County Construction and Property Standards Department.

    (2)

    Section 102.2, Administrative Authority Having Jurisdiction. Unless otherwise provided for by law, the Administrative Authority shall administer and enforce this code.

    (3)

    Section 102.3, Duties of the Administrative Authority. The Administrative Authority shall maintain public office hours necessary to administer the provisions of this code and amendments thereto and shall perform the following duties:

    a.

    Require submission of and examine plans, specifications, drawings, descriptions, or diagrams where necessary to show clearly the character, kind and extent of swimming pool work covered by the applications for permit and upon approval thereof shall issue the permit applied therefor.

    b.

    Collect all fees for permits issued as provided by this code.

    c.

    Enforce the provisions of this code and inspect swimming pool work authorized by permit to assure compliance with the provisions of this code or amendments thereto.

    d.

    Reject all work done or materials used or being used which do not comply with the provisions of this code and amendments thereto.

    e.

    Order changes in workmanship or materials or both essential to obtain compliance with all provisions of this code.

    f.

    Investigate any construction or work regulated by this code and issue such notices and orders as provided in Sections 104 and 105.2.

    (4)

    Section 105.1.1. No swimming pool installation, alteration or repair work shall be commenced until a permit shall first have been obtained from the Administrative Authority. Repair work which does not require an inspection will not require a permit.

    (5)

    Section 105.1.3. Any permit issued under this code by the Administrative Authority shall become invalid unless the work authorized by such permit is commenced within 180 days after its issuance, or if the work is suspended or abandoned for a period of 180 days after the time the work is commenced; provided, however, that one extension of time, for a period not exceeding 90 days, shall be allowed by the Building Official so long as such an extension is consistent with all ordinances existing at the time it is granted. Requests for extensions must be in writing and be submitted to the Building Official before the permit becomes invalid. The Building Official's extensions shall also be in writing.

    (6)

    Section 105.3.2. When required by the Building Official, four or more sets of drawings, drawn to scale with sufficient clarity and detail to indicate the nature and extent of the work, shall accompany every application. Such drawings shall contain information, in the form of notes or otherwise, as to the quality of materials, where quality is essential to conformity with this code. Such information shall be specific and complete and shall include information required by Sections 105.3.3, 105.3.4, and 105.3.5.

    (7)

    Section 105.3.3. Plot or site plans with dimensions and drawn to scale showing at least the following:

    a.

    Property lines, easements, rights-of-way of record and overhead utilities adjacent to pool area or over the property.

    b.

    Existing structures, fencing, retaining walls, and other relevant characteristics adjacent to pool area.

    c.

    Proposed pool shape, dimensioned and located to show setbacks, side and rear yards, and clearance from existing structures adjacent to pool area.

    d.

    Proposed mechanical equipment pad, dimensions and location as to setbacks and side and rear yards.

    e.

    All deck equipment items, if included.

    f.

    All new work shall be located in conformance with any approved site plan.

    (8)

    Section 105.3.4. A structural plan showing at least the following:

    a.

    Type of construction, whether gunite, poured concrete, prefabricated, or other.

    b.

    Pool dimensions, including the depth, and adequate cross sections.

    c.

    Data sufficient to show the correctness of the plans, including the reinforcing steel schedule and detail.

    d.

    Properly scaled, job specific angle of repose at worse condition.

    e.

    Engineered drawings for all retaining walls greater than four feet in height and measured from the grade at any point along the wall and shall include cross sections, footing sizes, and reinforcing steel.

    (9)

    Section 105.3.5. An equipment list showing at least the following:

    a.

    Type and size of filtration systems.

    b.

    Type and size of pool heater.

    c.

    A lot survey or copy of one accurately depicting the area affected by this construction.

    (10)

    Section 105.4.1. If the Administrative Authority determines that the plans, specifications, drawings, descriptions, or information furnished by the applicant is in compliance with this code, it shall issue the permit upon payment of the required fee. All work shall conform to the approved application and approved plans, specifications, drawings, descriptions, and information for which the permit has been issued, and any approved amendments to the approved application.

    (11)

    Section 105.5.2. Every applicant shall pay for each permit at the time of its issuance a fee as established by resolution adopted by the Board.

    (12)

    Section 105.5.3. Any person who shall commence any swimming pool work for which a permit is required by this code without having first obtained a permit therefor shall pay triple the usual permit fee as established by the Board.

    (13)

    Section 106.2, Notification. The person performing the work authorized by the permit shall notify the Administrative Authority that said work is ready for inspection within five business days of completing said work and putting the pool into use and operation. Failure to call for said inspection shall be deemed a violation of this code.

    (14)

    Section 304.1, Conformance Standard. Design, construction and workmanship shall be in conformity with ANSI/NSPI-4 1992 (Standard for Aboveground/Onground Residential Swimming Pools), and ANSI/NSPI-5 1995 (Standard for Residential Inground Swimming Pools), published by the National Spa and Pool Institute, or other accepted engineering practices.
