§ 18-34. Variances.

  • (a)

    Any person desiring to erect or increase the height of any Structures not in compliance with the regulations prescribed in this article may apply to the appropriate board of zoning appeals or adjustment having jurisdiction for a variance from said regulations. The application for a variance may be considered by the Sarasota County Board of Zoning Appeals for property within the unincorporated area of the County in accordance with the powers and duties of said agency as detailed in County Ordinance 75-38 (Appendix A to this Code), and the City of Venice Board of Zoning Adjustment for property within the City in accordance with the applicable ordinances of the City of Venice. A variance may be allowed where it is found that a literal application or enforcement of the regulations would result in practical difficulty or unnecessary hardship, and the relief granted would not be contrary to the public interest but do substantial justice and be in accordance with the spirit of this article and F.S. ch. 333.

    (b)

    Any variance granted shall require the attachment of appropriate conditions and safeguards to insure that the owner marks and lights the Structure in accordance with FAA Advisory Circular 70-7460-1 or subsequent revisions.
