§ 126-205. Establishment of districts.

  • A District may be established pursuant to this article by either of the following two methods:

    (a)

    Neighborhood Initiated Petition.

    (1)

    Pursuant to Board resolution, the filing of a petition with the Environmental Services Business Center signed by owners of property within the proposed District requesting the establishment of such District and identifying the utility service(s) being requested.

    (2)

    In the event a petition is submitted requesting potable water distribution only, the Board, as a condition to granting the request, may require the construction of and mandatory connection to central sewer in addition to potable water, based on the following factors:

    a.

    Planned Capital Improvement Program.

    b.

    Environmental factors.

    c.

    Location of infrastructure.

    d.

    Density.

    e.

    Public welfare.

    (b)

    Board Initiative. The Board may also establish by ordinance a District for any of the purposes authorized herein, upon its own initiative, with or without referendum, and may elect to require a referendum where a petition has been filed pursuant to subsection (a) of this section.
