§ 118-97. Enforcement/remedies.

  • (a)

    Operation of cable system without a franchise. The construction or operation of a cable system without first having been granted a franchise by the Board shall be treated as a misdemeanor, which may be punished as provided by law. Each day of such operation shall be deemed a separate offense.

    (b)

    Civil and administrative remedies. Any violation of this article can be enforced by injunction or other appropriate judicial writ or by proceedings before the Code Enforcement Special Master pursuant to F.S. ch. 162 and Sarasota County Ordinance No. 93-006, as amended (Chapter 2, Article VIII of this Code). In the event a Franchisee violates a provision of this article which is also contained in its franchise, the County shall elect whether to pursue civil enforcement action under this article or under the franchise. Notwithstanding the aforementioned, pursuant to F.S. § 125.69, nothing shall prevent this article from being criminally enforced in the same manner as misdemeanors are prosecuted.
