§ 110-502. Findings of fact.

  • The Board of County Commissioners hereby finds and declares that:

    (1)

    Certain local roadways, which have been dedicated or otherwise conveyed to the public in the unincorporated area of the County, have never been constructed to meet County standards and have never been accepted for maintenance by the County. These County non-maintained roadways may be adequate to handle the nature and volume of vehicular traffic using such roadways, but traffic circulation and safety would benefit from certain improvements to such roads.

    (2)

    Ordinance No. 99-078 provides authority to create improvement districts to provide for improvement of such roads, which are designed primarily to serve particular residential, commercial, and other property. The costs of such improvements should be funded by the properties that are specially benefitted by such improvements.

    (3)

    The County does not intend to assume, nor will the County assume, maintenance responsibility for the roadways improved pursuant to the program established herein. In order for the County to assume maintenance responsibility for such roadways, the roadway must be improved, pursuant to Ordinance No. 90-067, as amended, or with private funding, to current County standards as established in the Sarasota County Land Development Regulations and accepted for maintenance by Sarasota County Public Works Business Center.

    (4)

    The Board of County Commissioners of Sarasota County has the authority to establish improvement districts pursuant to Section 125.01(1), Florida Statutes, the Sarasota County Charter, and Sarasota County Ordinance No. 99-078, as may be amended from time to time.

    (5)

    Pursuant to Sarasota County Ordinance No. 99-078, Section 6(1), at least two-thirds of the owners of the property within the area described in section 110-505 of this article have by petition requested that said District be created. The public roadway which is the subject of this improvement district satisfies the eligibility criteria of Sarasota County Ordinance No. 99-078, Section 5.
